SaberNet and its affiliates provide to business and consumer users several information technology related services, including such services as Internet access, various electronic mail (email) packages and services, world-wide web site hosting arrangements, and other online and Internet related services. It is contrary to SaberNet policy for any Customer to effect, or participate in, any of the following activities through a SaberNet-provided service: To engage in any violation of California Business and Professions Code sections which address electronic messaging, electronic mail or any other electronic information exchange; To post, or cause the posting of, a single article or advertisement to more than ten (10) UseNet or other newsgroups, forums, email lists or other similar groups or lists; To post to, or cause posting to, any UseNet or other newsgroup, forum, email mailing list or other similar group or list, articles which are off-topic according to the charter or other owner-published FAQ or description of the group or list; To send, or cause the sending of, unsolicited emailing to more than twenty-five (25) email users where said users are not subscribed recipients of such mailings, or when any unsolicited mailing to multiple recipients provokes a complaint from a recipient. For the purposes of this section, a mailing to multiple recipients means a single mailing to multiple recipients or multiple mailings of the same content or substantially the same content to a number of recipients or to individual recipients. For the purposes of this section, a subscribed recipient means a person who actively requested delivery of information from the sender. For the purposes of this section, actively means that the requestor must have specifically asked for delivery. A person has not requested delivery by failing to act to remove or disqualify themselves from delivery.
