To best prevent agency overreach, we believe the predominant branch of government—the legislature—must clearly and narrowly delegate its exclusive lawmaking authority to agencies. The judiciary can advance this rule of law approach by narrowly construing agency delegations to the explicit boundaries of enabling statutes.
