Mediation is useful in highly-polarized disputes where the parties have either been unable to initiate a productive dialogue, or where the parties have been talking and have reached a seemingly insurmountable impasse. Mediation is an intelligent means to a just solution. It is controlled entirely by the parties. The parties always retain their right to litigate if an agreement is not reached, and even if an agreement is not reached, mediation usually narrows the scope of what will be litigated. It can reduce the cost and length of litigation. Why Mediate? People generally consider using mediation to deal with a dispute to avoid a lawsuit or terminate legal proceedings because compared to a lawsuit, mediation is a faster, more confidential, and a less expensive way to deal with conflict.
